General Terms & Conditions for Visiting Boats
Vereniging Het Jacht – Amsterdam
- 1. Applicability
- These terms and conditions apply to the use of berths and facilities of Vereniging Het Jacht.
- The marina is operated by a non-profit association managed by its members.
- By using the marina, including mooring a vessel, the user agrees to these terms.
- 2. Berths and Use
- Visiting berths are available only with the permission of the harbour master.
- Allocation of a berth is temporary and does not confer any right to a permanent or future berth.
- The association reserves the right to relocate a vessel or terminate the stay if deemed necessary in the interest of order, safety, or management.
- 3. User Responsibility
- The vessel must be maintained in a seaworthy and safe condition at all times.
- The user is responsible for adequate insurance of the vessel, including third-party liability.
- Mooring, stay, and use of the marina facilities are entirely at the user’s own risk.
- 4. Order, Peace, and Safety
- Peace, order, and safety must be respected within the marina.
- Causing nuisance, danger, or disturbance is not permitted.
- Instructions given by the harbour master must be followed at all times.
- 5. Facilities
- Electricity and potable water are provided subject to availability.
- Electrical connections are limited to a maximum of 16 amp.
- Facilities must not be used improperly or unsafely.
- Misuse may result in denial of access to facilities or immediate termination of the stay.
- 6. Payment and Rates
- Rates apply per night and are published on the website and/or within the marina.
- Payment must be made via the Blue Water App or in cash.
- In the event of non-payment, the association may terminate the stay and have the vessel removed at the user’s expense.
- 7. Liability
- The association accepts no liability for damage to or loss of vessels or other property.
- The association is not liable for injury or damage caused by, including but not limited to:
- weather conditions
- water levels
- fire
- theft or vandalism
- acts of third parties
- The user indemnifies the association and its volunteers against claims by third parties.
- 8. Supervision and Measures
- The harbour master supervises the marina on behalf of the association.
- Failure to comply with these terms may result in appropriate measures, including immediate termination of the stay.
- 9. Governing Law
These terms are governed exclusively by Dutch law.
